Power of Attorney
A power of attorney is a legal document given by a person to a spouse, partner, child, trusted friend or any other trusted individual. The power of attorney gives the trusted individual of your choice the right to act on your behalf by giving that person the right to perform any act, power, duty, right or obligation whatsoever that you may have or acquire. If the power of attorney is "durable" it continues to be effective even if a person becomes incompetent.

Examples of tasks that can be accomplished with a power of attorney include: paying bills and debts, collecting money and social security, endorsing checks, opening and closing bank accounts, purchasing and selling real estate, managing real estate, exercising voting rights in corporate and condominium matters, temporarily running a business or partnership, investing in stocks or bonds, filing tax returns, accessing safe deposit boxes, making estate planning decisions, establishing living and irrevocable trusts, making gifts, and making health care decisions.
Powers of attorney can avoid the appointment of a guardian or conservator for the management of assets. Getting a guardian or conservator appointed in probate court is very expensive, time consuming and usually is intrusive so a power of attorney can save a family a lot of money and aggravation.
